{"id":5861,"date":"2020-12-03T06:31:59","date_gmt":"2020-12-03T06:31:59","guid":{"rendered":"https:\/\/dev.wissenschaftliche-integritaet.de\/kommentare\/faq-verfahren\/"},"modified":"2021-06-16T19:49:12","modified_gmt":"2021-06-16T19:49:12","slug":"faq-verfahren","status":"publish","type":"kommentare","link":"https:\/\/dev.wissenschaftliche-integritaet.de\/en\/comments\/faq-verfahren\/","title":{"rendered":"FAQ on procedures in cases of alleged research misconduct"},"content":{"rendered":"\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"true\" data-scroll=\"false\" data-scroll-offset=\"0\"><h4 id=\"at-58610\" class=\"c-accordion__title js-accordion-controller\" role=\"button\">How is it possible to ensure that the entire investigation procedure is carried out as promptly as possible?<\/h4><div id=\"ac-58610\" class=\"c-accordion__content\">\n<p>Established measures include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Setting clear deadlines<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Settting up a transparent process regarding the sequence of procedural steps, including the required time frame<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The more severe the accusation, the longer the proceedings can take.<\/li><\/ul>\n\n\n\n<p><\/p>\n<\/div><\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"true\" data-scroll=\"false\" data-scroll-offset=\"0\"><h4 id=\"at-58611\" class=\"c-accordion__title js-accordion-controller\" role=\"button\">Is every violation of the principles of good research practice automatically a case of research misconduct?<\/h4><div id=\"ac-58611\" class=\"c-accordion__content\">\n<p>Not every violation or breach of the rules of good research practice constitutes research misconduct. Only those intentional or grossly negligent violations that are described as offences in an institution\u2019s rules and regulations can be considered to be cases of research misconduct.<\/p>\n<\/div><\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"true\" data-scroll=\"false\" data-scroll-offset=\"0\"><h4 id=\"at-58612\" class=\"c-accordion__title js-accordion-controller\" role=\"button\">Should ombudspersons and\/or commissions process anonymous complaints?<\/h4><div id=\"ac-58612\" class=\"c-accordion__content\">\n<p>The explanatory notes on Guideline 18 state the following:<\/p>\n\n\n\n<p>HEIs and non-HEI research institutions are responsible for deciding whether to investigate anonymous allegations. Disclosures made anonymously can only be investigated if the complainant provides the party investigating the allegation with solid and sufficiently concrete facts.<\/p>\n\n\n\n<p>The DFG Rules of Procedure for Dealing with Scientific Misconduct (VerfOwF) stipulate that anonymous disclosures are to be reviewed, see item III.1.a).<\/p>\n\n\n\n<p>Anonymous disclosures are often the only way to make accusations, especially in connection with professional dependency relationships.<\/p>\n<\/div><\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"true\" data-scroll=\"false\" data-scroll-offset=\"0\"><h4 id=\"at-58613\" class=\"c-accordion__title js-accordion-controller\" role=\"button\">Guideline 6 of the Code of Conduct explicitly limits an ombudsperson\u2019s term of office. Does this regulation apply to members of investigating committees, too?<\/h4><div id=\"ac-58613\" class=\"c-accordion__content\">\n<p>This would be possible and reflect the fundamental notion of avoiding dependency relationships; it is not a mandatory requirement under the Code, however.&nbsp;<\/p>\n\n\n<div id=\"links-block_60c1c06df124f\" class=\"kodex__comments-full--used-links links\"><a class=\"kodex__comments-full--used-links \" href=\"https:\/\/dev.wissenschaftliche-integritaet.de\/en\/comments\/term-of-office-of-ombudspersons\/\"  >Term of office of ombudspersons<span><\/span><\/a><\/div><\/div><\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-pb-accordion-item c-accordion__item js-accordion-item no-js\" data-initially-open=\"false\" data-click-to-close=\"true\" data-auto-close=\"true\" data-scroll=\"false\" data-scroll-offset=\"0\"><h4 id=\"at-58614\" class=\"c-accordion__title js-accordion-controller\" role=\"button\">Who do I contact with regard to matters of good research practice or if I suspect research misconduct? What should I consider when making an allegation?
